As reported by ESPN, Kansas prosecutors have taken a significant step in the legal case involving Jackson Mahomes, brother of Kansas City Chiefs star Patrick Mahomes.

On Tuesday, a motion was filed to dismiss three felony charges of aggravated sexual battery. However, a misdemeanor battery charge is set to remain.

Johnson County Assistant District Attorney Megan Ahsens filed the motion, citing a lack of cooperation from the alleged victim as a key factor.

In response to the development, Jackson Mahomes’ attorney, Brandan Davies, asserted his client’s innocence. Davies stated that Mahomes “has done nothing wrong” and expressed confidence that the truth would ultimately prevail.

The initial charges against Jackson Mahomes, stemmed from events at Aspens Restaurant and Lounge in Overland Park, Kansas, on February 25. Allegations included Mahomes shoving a male waiter and forcibly kissing the restaurant’s owner, Aspen Vaughn, without her consent.

“He forcibly kissed me out of nowhere, and I’m telling him, pushing him off saying ‘what are you doing?’ and then he did it two more times,” said Aspen Vaughn.

The legal case has had notable repercussions for Aspen Vaughn, who closed the restaurant in August, citing negative publicity, death threats, harassment, and vandalism. Vaughn had accused Mahomes of causing trouble in the past.

The court filing revealed that prosecutors received an affidavit from Vaughn’s attorneys, stating her refusal to testify. Despite this, prosecutors intend to proceed, raising the existence of surveillance video capturing the encounter.

The filing indicated difficulties in serving subpoenas to Aspen Vaughn, with allegations that she is actively avoiding court.

While the felony charges are being dropped, the misdemeanor battery charge involves the waiter’s alleged shoving.

In April 2023, Patrick Mahomes’ wife, Brittany defended Jackson, describing critics as “ignorant.” She urged those without firsthand experience to withhold judgment.

Jackson Mahomes is set to attend a preliminary hearing in Johnson County court at 1:30 p.m. this Wednesday.
